ATV, Golf Cart, and Other Recreational Motor Vehicle Use

Dear Members,

           The Board has recently received several complaints of ATV, Golf Cart, and other recreational motor vehicle use on the streets, sidewalks and common area lots of Ashford Park. After consultation with our attorney, the Board held a special meeting on May 4, 2020 to consider and address this issue. The following was passed by resolution of the Board:

Common Area Lots and Other Association Property

           ATV, Golf Cart, and Other Recreational Motor Vehicle use, whether powered by gasoline or electric motor, is strictly prohibited on all Association property including common area lots within the Ashford Park subdivision. The Board finds that this activity is dangerous and presents serious and unnecessary risk of liability and shall not be permitted on property owned by Ashford Park Property Owners’ Association, Inc. at any time.

Public Streets and Sidewalks

           Under State and Local law it is illegal to operate any motor vehicle upon any city street without a state issued license plate. Further, it is illegal to operate any motor vehicle at any time upon a sidewalk or sidewalk area. While certain specified areas within the city of Foley are allowed by city ordinance to permit Golf Cart traffic, no street within the Ashford Park subdivision is included in such ordinance. ATV, Golf Cart, and Other Recreational Motor Vehicle use is strictly prohibited on all streets and sidewalks within the Ashford Park subdivision, except as otherwise provided by law.

Reporting Violations

           Any member witnessing suspected violations involving illegal motor vehicle use on streets and/or sidewalks within the subdivision should immediately report such activity to the Foley Police Department at (251) 943-4431.

           Any member witnessing prohibited use of motor vehicles on Association property should immediately report such activity to Laura Daily, Secretary at 251-752-3799 or JoAnne Fisher at 251-654-5325

NOTE FROM CITY ENGINERRING: We are currently preparing temporary construction easements to present to the YMCA and School Board. If they agree and sign the easements the City would construct a ditch (as shown by the dashed line on attachment) to divert the drainage channel away from the school pond. This would greatly reduce the potential for beaver activity to block drainage flow from the north by divorcing this flow from the pond. We plan to mail the easement forms out this week.

The Foley City Council will be meeting on Monday, August 16th. The meeting will take place at the Foley Civic Center at 4PM. Mask and social distancing are required. This is a great time for Ashford Park owners to attend the meeting to find out how the City's stormwater design plan and implementation will affect Ashford Park's retention ponds. Happy 4th of July to all our Ashford Park members. We hope that you and your family have an enjoyable and SAFE weekend. In that spirit, please keep in mind that it is illegal to shoot/ light fireworks within the Ashford Park neighborhood. It is actually illegal to do so with the City of Foley.
